1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the AnswerVault platform ("Service"), operated by Crocker Digital Ltd, a company registered in England and Wales (Company No. 17008789) ("we", "us", "our").
By creating an account or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
If you do not agree to these Terms, you must not use the Service.
2. Accounts
To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must notify us immediately at support@answervault.co.uk if you become aware of any unauthorised use of your account.
You must be at least 18 years old to use the Service. The Service is intended for business use by organisations, not for personal consumer use.
3. Subscription and Billing
The Service is offered on a subscription basis with monthly or annual billing. Current pricing is displayed on our pricing page.
Free trial: New accounts receive a 14-day free trial. No credit card is required for the trial. At the end of the trial period, you must select a paid plan to continue using the Service.
Billing: Subscriptions are billed in advance on a monthly or annual basis. All prices are in British Pounds (GBP) and are exclusive of VAT where applicable. Payments are processed securely by Stripe.
Price changes: We may adjust pricing from time to time. We will give you at least 30 days' notice before any price increase takes effect. If you do not agree with a price change, you may cancel your subscription before it takes effect.
Refunds: We offer a full refund within 14 days of your first paid charge. After that, no partial refunds are available, but you may cancel at any time and your access will continue until the end of your current billing period.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Upload or transmit any content that is defamatory, obscene, fraudulent, or otherwise objectionable.
- Attempt to gain unauthorised access to the Service or its related systems or networks.
- Interfere with or disrupt the integrity or performance of the Service.
- Reverse engineer, decompile, or disassemble any aspect of the Service.
- Use the Service to store or transmit any malicious code, viruses, or harmful content.
- Resell, sublicense, or distribute the Service to third parties without our written consent.
- Use automated means (bots, scrapers) to access the Service except through our documented APIs.
5. Your Content and Data
You retain all ownership rights in the content and data you upload to the Service ("Your Content"). By uploading content, you grant us a limited licence to store, process, and display Your Content solely to provide and improve the Service.
You are responsible for ensuring you have the necessary rights to upload Your Content and that it does not infringe any third-party intellectual property rights.
We do not access, use, or share Your Content for any purpose other than providing the Service, unless required by law.
6. Intellectual Property
The Service, including its design, features, code, documentation, and branding, is owned by Crocker Digital Ltd and is protected by copyright, trademark, and other intellectual property laws of England and Wales and international treaties.
These Terms do not grant you any right, title, or interest in the Service except for the limited right to use it in accordance with these Terms.
7. Limitation of Liability
To the maximum extent permitted by law, Crocker Digital Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising out of or in connection with your use of the Service.
Our total aggregate liability for any claims arising under these Terms shall not exceed the total amount you paid to us in the 12 months preceding the claim.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
8. Termination
By you: You may cancel your subscription at any time through the Service's settings page or by contacting us. Your access will continue until the end of your current billing period.
By us: We may suspend or terminate your account if you breach these Terms, fail to pay applicable fees, or if we reasonably believe your use poses a security risk to the Service or other users. We will provide reasonable notice where practicable.
Data retention: Upon termination, your data will be retained for 30 days to allow you to export it. After 30 days, your data will be permanently deleted.
9. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
10. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
11. General Provisions
Entire agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Crocker Digital Ltd regarding the Service.
Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
